Problems: 1. Shorten breached the Prime Minister's ministerial code of conduct by not divesting his shareholding in East Malvern Community Financial Services Limited on becoming a minister. After Open Politics revealed this on August 27, Shorten stated he would take steps to divest them. He added that the shares were inherited from his late mother and that he was not clear whether they were his to sell. Another issue is that the shares were not liquid (could not be sold easily) as they are not on the ASX. Nonetheless, Shorten should not have waited for our revelation before beginning the divestment process.
2. Shorten breached the ministerial code of conduct a second time by accepting a First Class Emirates upgrade. Section 3.20 of the the code and the associated gift guidelines do not allow ministers to accept gifts or benefits above $750 from an official source (Emirates is owned by the Government of Dubai).
